New HIPAA Rules Take Effect January 1, 2012

The provisions of the Health Insurance Portability and Accountability Act (HIPAA) of 1996 and enacted by Congress in 1996, cover all chiropractic practices. Every DC in practice should have a written HIPAA compliance plan on file. To enhance the effectiveness of the security and privacy provisions of HIPAA, new rules will take effect on January 1, 2012 that will establish new requirements in electronic data submission and storage. HIPAA Version 5010 is designed to reduce ambiguity, increase the consistency of information and enable more precise industry benchmarks. Legislation in House and Senate Seeks to Expand Chiropractic Coverage for Veterans

There are currently two bills before Congress, one in the House (HR 329) and the other in the Senate
(S 1147) to expand chiropractic access in all facilities of the US Department of Veterans Affairs (DVA). HR 329 was introduced in the House by Rep Bob Filner (D-CA). This bill requires that the VA have a doctor of chiropractic on staff at all major VA medical facilities by 2014. S 1147 was introduced by Sen. Richard Blumenthal (D-CT) and also requires system-wide chiropractic access to all of the facilities of the DVA by 2014. This legislation, if passed would give veterans a choice of health care which could make a difference to their treatment as according to a VA report (Jan 2009), neuromusculoskeletal ailments, principally joint and back disorders, were the top health problem of veterans returning from Iraq and Afghanistan. Currently 80% of VA medical facilities do not include chiropractic services. This legislation would change that.

HR 531 Offers New Pathway for DCs to Provide Needed Care in Areas with Health Shortages

Rep. Bruce Braley (D-IA) has introduced a bill in the House (HR 531), Access to Frontline Health Care Act of 2011, that would help address the inadequate distribution of health care professionals and facilities available to citizens in all parts of the United States. This legislation would authorize the participation of doctors of chiropractic in a federal program through which a portion of the doctor’s student loan obligation might be paid off by “frontline” service for a period of full-time service at a health care facility serving a frontline care facility in an underserved area. HR 531 places a new emphasis on interdisciplinary cooperation and offers a new pathway through which doctors of chiropractic can provide urgently needed services in underserved areas.
